These Terms of Use (the “Terms”) govern your use of and access to www.nikkiyogaclasses.in and its sub-domains and affiliated sites, as well as Nikki Yoga Studio (“Nikki” “my”, “me” or “I”) pages and accounts on Facebook®, Twitter®, LinkedIn®, Instagram®, and YouTube® (the “Sites). Please read both these Terms and my Privacy Policy carefully, which is incorporated into these Terms. By using any or all of the Sites, you accept and agree to be bound by these Terms. If you do not want to agree to be bound by these Terms, do not use the Sites. I may modify these Terms from time to time, and any modifications will be effective immediately when I post them. All changes I make will be reflected in the date at the top of the document. You are responsible for reviewing any modified terms. Your continued use of a Site following any changes means you accept and agree to any changes. For your convenience and future reference, the date of the most recent revision of these Terms is listed above so that you may compare different versions to determine what, if any, changes have been made.
SITE CONTENT.
Nikki Yoga Studio exclusively owns and controls the Sites, which provides information about my products and services and may, from time to time, provide access to educational materials pertaining to a variety of website design, Content Creation, yoga classes. You agree that use or access to any or all of the Sites does not, standing alone, create any sort of representation or future promise. The unauthorized reproduction, use of, or theft of any content, written, photographic, or otherwise, is expressly prohibited. By using the Sites, you expressly agree to pay a fine of Rupees 5000 per incident for any unauthorized use of our content, at the sole discretion of Nikki Yoga Studio.
INTELLECTUAL PROPERTY.
Unless explicitly stated otherwise, as between you and Nikki Yoga Studio , Nikki Yoga Studio owns all right, title, and interest in and to the Sites, including, without limitation, graphics, site content, design, organization, compilation and other matters related to or included on the Sites. My name, Nikki Yoga Studio and all related names, product and service names, logos, slogans, and designs are my trademarks and you may not use these marks without my prior written permission. All other names, logos, product and service names, designs and slogans on the Sites are the trademarks of their respective owners and should not be used without those respective owners’ permission. You are granted a non-exclusive, non-transferable, revocable license to access and use the Sites and the resources available for download from the Website strictly in accordance with these Terms.
THIRD PARTY RIGHTS.
Content and materials posted to the Site may be the copyrighted content of others (“Third Party Content”) that is used by Nikki Yoga Studio either by permission or under Section 107 of the Copyright Act as “fair use” for purposes such as education and research. I respect the intellectual property of others and ask that you do the same. Users must obtain permission from the owners of any Third-Party Content before copying, distributing or otherwise using those materials. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication, or commercial exploitation of downloaded material will be permitted without the express permission of the copyright owner.
If you believe that your work has been copied on one or more of the Sites in a way that constitutes copyright infringement or otherwise violates your intellectual property rights, please contact me via email at the contact information listed below and provide the following: (i) identification of what is claimed to have been infringed; (ii) identification of what is claimed to be infringing; (iii) your contact information (or the contact information of the person we need to contact about the infringement); (iv) a statement that the person submitting the complaint is doing so with a good faith belief that use of the material in the manner complained of is not authorized by the owner, its agent, or the law; (v) a statement that the information provided is accurate, and under penalty of perjury; (vi) a physical or electronic signature of the person submitting the complaint; and (vii) if that person is not the owner of the content at issue, a statement that the person submitting the complaint is authorized to act on the owner’s behalf.
LINKING TO OUR SITES.
Anyone linking to the Sites must comply with all applicable laws and must not: (i) misrepresent its relationship with Nikki Yoga Studio; (ii) present false or misleading information about Nikki Yoga Studio; or (iii) contain content that is reasonably considered profanity, offensive, defamatory, vulgar, or unlawful.
ADVERTISEMENTS AND LINKS.
I may at times include advertisements on the Sites. Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Sites are solely between you and such advertiser. Any opinions, advice, statements, services, offers, or other information or content expressed or made available by advertisers, including information providers, or any other end users are those of the respective author(s) and not my own. You agree that I shall not be responsible or liable for any loss or damage of any sort incurred as a result of any such dealings or as the result of the presence of such advertisers. Feedback
If you provide feedback to Nikki Yoga Studio regarding the Service (“Feedback”), you acknowledge that the Feedback is not confidential and you authorize Nikki Yoga Studio to use that Feedback without restriction and without payment to you. Accordingly, you hereby grant to Nikki Yoga Studio a nonexclusive, royalty-free, fully-paid, perpetual, irrevocable, transferable, and fully sublicensable right to use the Feedback in any manner and for any purpose.
Changes to Terms
We reserve the right to modify these Terms from time to time. If we modify these Terms, we will indicate that we have done so on the Nikki Yoga Studio Website or otherwise provide you notice. It is your responsibility to review these Terms regularly. Use of the Service after the effective date of a modification constitutes your acceptance of any modified Terms.
Termination
You may terminate your use of the Service at any time by terminating your account and deleting any Nikki Yoga Studio software from your device or personal computer. Termination of your account is your sole right and remedy with respect to any dispute with Nikki Yoga Studio regarding the Service or these Terms. Nikki Yoga Studio may suspend or terminate your access to the Service at any time, for any reason. If Nikki Yoga Studio suspects that you have violated any provision of these Terms, Nikki Yoga Studio may also seek any other available legal remedy. Your rights under these Terms will terminate automatically if you fail to comply with any of these Terms. Upon termination, you must destroy or delete any copy of Nikki Yoga Studio software in your possession. You remain solely liable for all obligations related to use of the Service, even after you have stopped using the Service. Neither Nikki Yoga Studio nor any of its licensors, suppliers, or publishers are liable to you or to any third party for any loss caused by any termination of the Service or termination of your access to the Service.
Nikki Yoga Studio Membership
You can become a Nikki Yoga Studio Member by signing up to pay monthly, quarterly, or annual fees for unlimited access to our “Training Plans.” Training plans are offline / online classes that we offer as part of Nikki Yoga Studio Membership.
Recurring Billing
The membership fee will be billed at the beginning of the paying portion of your membership and each month or quarter or year thereafter unless and until you cancel your membership. We automatically bill your payment method each month on the calendar day corresponding to the commencement of your paying membership. We reserve the right to change our billing timing, in particular, if your payment method has not successfully been charged.
No Refunds
Payments are non-refundable and there are no credits for partially used periods. Following a cancellation, however, you will continue to have access to your Nikki Yoga Studio Membership through the end of your current billing period.
Cancellations
You may cancel your Nikki Yoga Studio Membership at any time for any reason. To cancel your recurring subscription, please email nikkiyogastudio@gmail.com regarding the same. Following a cancellation, you will lose access to all Training Plans you enrolled in during your membership at the end of your billing period. If you choose to sign back up as a member, your billing date will update to the day you paid.
Third-Party Content
We may email or provide you coupons, offers, and other specials from third parties (collectively “Promotions”). Nikki Yoga Studio is not responsible for the redemption, errors, omissions, or expiration of Promotions. All Promotions featured as a part of the Service are subject to change without notice and we have no control over their legality or the ability of any merchant to complete the Promotion (including, the sale in accordance with the offer).
The Service may contain links to Web pages and content of third parties (“Third-Party Content”) as a service to those interested in this information. We do not monitor, endorse, or adopt, or have any control over, any Third-Party Content. We undertake no responsibility to update or review any Third-Party Content and can make no guarantee as to its accuracy or completeness.
Additionally, if you follow a link or otherwise navigate away from the Service, please be aware that these Terms will no longer govern. You should review the applicable terms and policies, including privacy and data gathering practices, of any Third-Party Content provider to which you navigate from the Service. You access and use Third-Party Content at your own risk.
